Home Theft stolen car

My car is stolen but my insurance doesn't pay, why?

Your car has been stolen, and as if this wasn't bad enough, your auto insurance doesn't pay out either. Why can your insurer do this? Does the insurer even have the right to do this? This all depends on a number of factors: including your policy conditions and whether you have taken all necessary measures to prevent theft.

With third-party insurance, theft is never covered: third-party insurance only covers damage done to another person. Do you still want to be covered in case of theft? Then choose limited or full hull insurance. With one of these insurance policies, you are initially covered against car theft. Be aware that even with these policies, there may be certain grounds for exclusion. Did you not lock the car properly? Is your car key not securely stored or have you failed to meet other security requirements of the insurer? Then the insurer may not pay compensation.

The insurer will also not reimburse damages if your car is recovered within 30 days. If your car is recovered and you have met all the conditions, the insurer will, however, reimburse the damage caused to your car by the theft.

Car stolen and insurance doesn't pay, now what?

Check thoroughly what type of insurance you have. In doing so, look carefully at possible grounds for exclusion from your insurance and the applicable policy terms. Always contact your insurer to find out the exact reasons for refusal. If after this you think you are entitled to the benefit of your insurance, you would be wise to seek (legal) advice. Once you have done this and are (almost) certain that you are in your right, you can think about possible next steps. You can then object to your insurer's decision.

Car stolen insurance doesn't pay: object to claim rejection

Object to your insurer's decision in writing. Make sure that you collect everything that can serve as evidence. This may include receipts for security devices purchased (cameras, steering locks, additional alarms) or a police report. Be sure to dispute any grounds for exclusion cited by your insurer, with added evidence. When preparing the documents, it is best to use a legal professional to ensure you meet all the requirements of the objection process.

The insurer will make a decision on your objection and declare the objection founded or unfounded. Is the objection declared founded? Then you will still receive your benefits! Any questions? Please contact us.
