Conflict due to dismissal covered by legal expenses insurance?
With legal expenses insurance, you can choose your own coverage by choosing modules. This way you can tailor the insurance to your own needs. One of the modules is legal assistance 'work'. This module is also called 'income'. Here you are insured for legal help with conflicts at your work and you get legal assistance with dismissal.
It may happen that you are fired. This could be for a variety of reasons: you are not performing adequately according to your employer, you are on long-term sick leave, or you are being laid off due to a reorganization. When this happens, you want to resolve it as best you can. It is not always possible to work it out with your employer.
Should you find yourself in any of the above situations, there are a number of things you can do yourself, if possible:
- Engage with your employer to reach a solution
- Keep correspondence (emails and/or letters) from/with your employer
- State clearly if you do not understand something and ask for additional explanation or clarification
- Have your employer put a proposal in writing. Make sure you do not agree to the proposal immediately and that you have time to think about it

Instant dismissal
Are you being summarily dismissed? Then your employer must have a good reason, otherwise the dismissal is not legally valid. A valid reason could be, for example, work refusal or theft. With this type of dismissal, you will lose your job immediately and will not be entitled to benefits. Legal expenses insurance can be used to determine if the dismissal is valid.

In case of bankruptcy or reorganization
Should the company where you work go bankrupt or a reorganization takes place within the company, you may lose your job. It may be that you have not received your salary for some time due to financial problems within the company. With legal assistance insurance you will get help in finding out what you are entitled to in this situation and who you should contact if you need legal help.
If temporary contract is not renewed
With a temporary contract, your employer must follow the same rules in the event of an early termination as with a permanent contract. That is, the contract cannot simply be terminated earlier if you do not perform well or if there is less work. When assessing whether the dismissal is legally valid, you can rely on your legal expenses insurance.
Note: You are not insured if your dismissal occurred before you took out your legal expenses insurance.
Is legal expenses insurance mandatory?
Legal expenses insurance is not mandatory, but it proves to be very useful in practice. Do you work abroad? For certain disputes, insurers may only offer coverage in the Netherlands and not throughout Europe. Pay close attention to this.
